$ 450,000.00- A 25 year old man was struck head-on when a car crossed over into his travel lane in Scituate. The man’s vehicle burst into flames following the collision, but people at the scene quickly removed him from his truck and likely saved his life. The man still sustained severe injuries that included complex fractures of his femur and patella.  He was hospitalized for two weeks post-accident, had three surgical procedures and had hardware implanted in his left leg. The man attended physical therapy for nearly a year. Although he may require an additional surgery in the future to remove the hardware, the man made a remarkable recovery under the circumstances.  The claim was settled without the need to file suit per the man's wishes.  Our office worked hard to secure expert medical evidence that documented both the man’s present condition as well as his future prognosis. Once that process was completed, we were able to successfully resolve the man’s claim during a face to face settlement conference with the insurance carrier’s representative at our office.    
$ 275,000.00- A 29 year old woman was stopped in her car when it was struck by an SUV. The driver of the SUV began to pull out into traffic on Route 2 in Warwick then backed up into the woman’s car when he saw that he could not safely pull out.  The woman had undergone a “tummy tuck” procedure two months earlier that was necessary due to complications with her stomach arising from the birth of her twin sons.  The woman’s previous surgical  repair was ruined, resulting in the tearing of her abdominal muscles.  She required bed rest and multiple surgeries to repair the damage, and subsequent post-operative infection that developed. Our office aggressively pursued the matter, and after intensive negotiations that culminated in a day long face-to-face negotiation with the responsible party’s insurance carrier, a structured settlement agreement was achieved on the woman’s behalf.
$ 240,000.00- A 53 year old woman was injured when she slipped and sustained a severe fracture-dislocation injury to her right ankle while working that required her to undergo three surgical procedures. At the time the woman was injured, there was an outside vendor servicing a copy machine within a couple of feet where the woman was walking at work.  After falling to the ground, the woman identified a clear oily substance on the floor that she had slipped on.  While initially apologizing and admitting responsibility, the man working for the outside vendor tried to change his story. The man alleged that he had no idea what the woman was talking about.  Through an aggressive investigation, our office was able to obtain a sworn witness affidavit from a woman who came out of her office immediately after the incident.  Not only did the woman over hear the man say that it was his fault and he would probably get fired for spilling this liquid, but she also saw the man pull a bottle of degreaser from his equipment bag and wipe the floor clean.  With the insurance carrier no longer challenging liability, we were able to settle the case to the woman’s satisfaction just prior to the filing of the complaint we had drafted and forwarded to the insurance company when they had initially offered $ 175,000.00 in settlement of the claim.
$ 226,000.00- A 55 year old woman was injured in a head-on collision with another vehicle. She suffered multiple injuries to her right wrist, left elbow and the rupture of a breast implant. A breast cancer survivor, the woman had previously undergone a double mastectomy with breast reconstruction and had been doing well until her involvement in the accident.  Following the repair of her implant, the woman developed post-operative infection and was forced to undergo four breast surgeries and two additional operations before she was returned to a state of good health.  Our office was able to obtain a fair settlement for the woman after months of negotiations.  Due to the fact that the person who caused the accident was underinsured and the woman was working when the collision took place, this settlement figure was reduced by tens of thousands of dollars in offsets for amounts that we had already obtained for the woman during the course of her claim by other sources such as her workers’ compensation insurance carrier.
$ 208,292.00- A 39 year old man was stopped in traffic when his vehicle was struck behind by another car.  He suffered from injuries to his neck and back, with the low back injuries being the most serious.  The man experienced progressive low back pain traveling down his leg.  MRI confirmed a disc injury that was consistent with the man’s complaints, and he was referred by his family doctor to a neurosurgeon.  Nerve testing confirmed radiculopathy and the doctor informed the man he was a surgical candidate.  The man feared surgery, but he underwent numerous nerve block injections in an effort to work and function without having to undergo surgery.  After collecting the $ 25,000.00 policy limits from the at-fault party’s auto liability insurance, we filed a claim with the man’s own insurance company for underinsured motorist benefits.  The man’s insurer had him examined by their own doctor, and they argued that the man’s injuries were unrelated to the motor vehicle collision.  When the man’s insurer only offered $ 5,000.00 to settle this claim, our office fought aggressively on the man’s behalf and won his case.  
 $ 125,000.00- A 57 year old woman was injured when her vehicle was struck in the front end by another car that had gone through a stop sign.  She suffered a torn rotator cuff in the collision that had to be surgically repaired.  Our office was able to obtain a settlement that our client was pleased with less than one year post-accident and just as she was being discharged from further medical treatment by her orthopedic surgeon. 
$ 125,000.00- A 37 year old man sustained injuries to his right shoulder and elbow when he was a passenger in a jeep that was struck by another vehicle.  He treated with an orthopedic surgeon and underwent rotator cuff repair, elbow surgery and extensive post-operative physical therapy.  Our office was able to secure the entire available policy limits on the man’s behalf despite the fact that the man did not miss any time from work.  After resolving the claim, we then took the extra step of negotiating with the man’s medical providers to reduce his bills and significantly increase the man’s recovery.
$ 100,000.00- A 59 year old man was injured when a school bus backed up into his small sports car, causing minimal damage. The bus driver did not know she had been in an accident and drove away until she was flagged down.  The man sustained an aggravation and worsening of degenerative disc disease in his lower back.  The insurer argued aggressively on the issues of both liability and damages.  However, by carefully examining the accident scene and utilizing the skill of a board certified neurosurgeon to prove the nature and severity of our client’s injuries, we were able to secure a significant settlement despite the fact that the man did not undergo surgery.
$ 100,000.00- A 52 year old woman sustained a fracture-dislocation injury to her right ankle when the car she was driving was struck by another vehicle. The woman elected to forego surgery for the ankle despite the recommendation of her treating orthopedic surgeon.  During negotiations, the insurer attempted to offer substantially less and relied upon the fact that the woman had a prior surgery on the same ankle. They also argued that her current refusal to have surgery meant that her injuries were not as serious as claimed.  Our office was able to communicate effectively with one of the leading foot and ankle specialists in the area and obtain a report that documented the seriousness of the woman’s injury, its relationship to the accident and the costs of the surgery she would eventually require.  The case settled shortly after we obtained this report for the full available policy limits.  
$ 99,500.00- A 59 year old woman was the driver of a car that was struck broadside by a truck pulling out of a parking lot onto a main roadway. She suffered from significant pre-existing degenerative disc disease in both the cervical and lumbar spine. As a result of her accident-related injuries, it was our contention that the woman was no longer able to work due to a severe aggravation and worsening of her pre-existing condition.  The insurer attempted to take a position that the woman's injuries were minor in nature, and that her main complaints were the result of her pre-existing conditions and unrelated to this accident.  By obtaining strong expert medical opinions and proving how the woman's functional abilities changed significantly pre and post accident, we were able to negotiate a settlement that was in accordance with the client's wishes.
$ 97,500.00- A 61 year old man slipped and fell on ice at a local pharmacy store, sustaining injuries to his right shoulder. After two unsuccessful attempts at rotator cuff repair, the gentleman applied for and received SSDI.  The pharmacy and company responsible for maintaining the parking lot denied any responsibility.  They further alleged that the man had pre-existing medical conditions unrelated to this incident that accounted for his disability and loss of income.  A lawsuit was filed on the man’s behalf and pre-trial discovery was completed. On the eve of trial, a mediation hearing was arranged. After an initial offer of $ 30,000.00, our office fought hard on the man’s behalf and we were able to secure an award that provided fair compensation to our client.

$ 92,500.00-   A 56 year old woman was a driver of a car that was struck by another vehicle that had made an illegal left turn.  She sustained a disc herniation at the C5-C6 level, C5 radiculopathy and a significant aggravation and worsening of degenerative changes in her neck.  Following conservative treatment that included nerve block injections, the woman elected to forego surgery over concerns over her ability to be a good candidate for a successful procedure due to unrelated medical conditions that included a cardiac blockage, high blood pressure and respiratory issues.  The insurer insisted that the woman’s claim amounted to nothing more than sprain type injuries, however, by working to reconstruct and present the woman’s past medical history our office was successfully able to prove that this person’s significant injuries were caused by the motor vehicle accident.
 

$ 80,000.00- A 61 year old disabled woman was crossing a street on her motorized wheelchair when her chair was struck by a tractor-trailer truck.  The truck dragged the woman, who was strapped into the chair, for approximately 70 feet.  During the incident, the woman sustained several cuts and abrasions that included a deep cut on her left elbow that developed into a serious bone infection called osteomyelitis. Although this was a serious condition that required the insertion of a PICC line and wound treatment for five months, the woman’s other injuries were miraculously minor in nature.  For reasons that remain unexplained, the police at the scene gave the woman a traffic ticket for “darting” out in front of the truck despite the fact that she was in the cross walk, the truck driver never saw her, and the woman’s chair was in front of the truck when it started from a complete stop according to a witness at the scene. Our office fought aggressively and took the woman’s traffic ticket to trial. After prevailing at the RI Traffic Tribunal on the woman's behalf, the insurer conceded liability. With liability no longer contested, we were able to achieve a settlement of the claim that the client was happy with shortly thereafter.      

$ 75,000.00- Workers' Compensation.  A 56 year old auto mechanic sustained severe crush injuries to his left hand and wrist when an engine block fell off a stand and pinned the man's hand between the engine and the motor mount.  He underwent two surgical procedures.  This settlement was negotiated at the man's request after he had collected more than $ 75,000.00 in weekly workers' compensation benefits and we had secured payment of all of his medical bills. 

$ 71,177.00- Workers' Compensation. A 50 year old man sustained a crush injury to his left hand while working for a construction company.  After undergoing three surgeries and collecting in excess of $ 75,000.00 in weekly benefits for more than two years our office was able to secure a fair settlement on the man’s behalf.  The employer and insurer had tried to argue that the man was no longer disabled from his injuries, however, our office was able to obtain and effectively present medical evidence that proved ongoing disability that led to the successful settlement for the injured worker.     

$ 66,300.00- Workers' Compensation. A 43 year old male was a counselor at a group home for mentally challenged adults. He sustained neck injuries when he was attacked by a patient during one of his shifts.  While acknowledging that the incident occurred and that their employee may have suffered a mild strain that was attributable to the attack, the employer and its insurer argued that the man’s main neck injuries were unrelated since he had undergone spinal surgery on his neck a year earlier.  Due to his deteriorating condition, our office went to court and obtained an order to allow the man to undergo surgery while this issue was being litigated.  After successfully proving in court that the man’s injuries were caused by the injury he suffered at work and securing the payment of his back benefits, our office was able to obtain a settlement for him once he had concluded his medical treatment and had already collected approximately $ 30,000.00 in weekly benefits.

$ 60,000.00- A 58 year old man was struck by a pick-up truck as he crossed a main street at a busy intersection. He was thrown in the air and propelled more than 60 feet after being struck.  The man suffered multiple fractures in his spine as well as a rib fracture and a right scapular fracture. Miraculously, the man went on to enjoy a complete recovery less than four months after being struck.  The claim was challenged by the insurer for the driver of the truck, alleging that our client was not walking in the crosswalk at the time he was struck.  Our office was able to secure a report based upon scientific principles of accident reconstruction that concluded the man could have been in the crosswalk when he was hit.  Based upon that report, we were able to secure the above offer.  Another factor in the decision to settle was that the man’s family did not wish to risk putting him through litigation due to several personal reasons.  Our own investigation also revealed that, even if the man had been in the crosswalk, it would have been physically impossible for him to be walking with a “walk” sign in his favor at the time he was struck.     

$ 59,000.00-  A 49 year old woman was a driver of a car that was rear-ended by another driver operating a rental vehicle. The woman sustained injuries to her lower back that included an S1 radiculopathy as well as an alleged L5-S1 disc herniation.  The insurer argued that their medical expert did not identify the disc abnormality on the MRI, and there was a difference of opinion between the hospital radiologist who read the films and the treating physician as to the severity of the findings and whether they were degenerative in nature.  There was also an issue with injuries from a prior accident that had occurred two years earlier.  After months of negotiations, the offer was substantially increased on the eve of litigation and we were able to resolve the case to our client’s satisfaction.
